Terms and Conditions

The purchase of products on www.dere.it requires the user to accept the Privacy Policy of De Re Monica – ditta individuale (di seguito DeRe). For information on personal data collection and processing methods on www.dere.it, please refer to the Privacy Policy of DeRe.

 

Product purchases on www.dere.it are governed by the following Terms and Conditions of sale.

 

1. Notes on the Terms and Conditions of sale

The Terms and Conditions apply to all orders and all purchases made on www.dere.it.

For purchases made on www.dere.it, Tonini Gianni sends his communications electronically via e-mail or electronic publication. By using this online offer, users accept that all declarations of intent, communications, disclosures and other notices are issued or delivered electronically, except in cases for which the law requires the written form.

The Terms and Condition may vary over time. Their date of effect is stated on www.dere.it.

Any changes to the Terms and Conditions will apply to orders placed as of the date of effect (included), provided that the amended Terms and Conditions are displayed on the website as applicable at that time. Before placing an order, users will be given reasonable opportunity to read these Terms and Conditions and will be required to accept them.

 

2. Personal account

Users are required to create a user account (personally identifying data or username). Users are required to keep their password confidential and restrict access to their password and their account. They shall take responsibility for any action carried out and purchase made using their account.

 

3. Placing the order

In order to purchase a product, the user is required to:

  • accept the applicable Terms and Conditions and the Privacy Policy of DeRe;
  • provide their name and address, telephone number, e-mail address, payment details and the other information requested;
  • provide a valid delivery address (please note that Tonini Gianni does not deliver to PO boxes or automatic delivery stations. Our orders are shipped via courier, who will request a signature upon delivery);
  • in case of debit/credit card payments, be the owner or authorized holder of a valid debit/credit card;
  • in case of PayPal payments, hold a valid PayPal account.

The user may place an order by proceeding to checkout after clicking on the “ADD TO CART” button. The user agrees that their order/s is/are a purchase offer for the product/s indicated in the order according to these Terms and Conditions.

Each order is considered a purchase of its own. All orders are subject to acceptance by Tonini Gianni, who reserves the right to refuse any order without providing any explanation (including, but not limited to, orders that are suspected of fraud). The user will be notified in case DeRe decides not to accept the order.

The user will have the opportunity to review their order/s, read and accept the Terms and Conditions, check the total price and characteristics of the order/s as well as the information provided and correct any input error before confirming the order/s.

 

4. Order processing and contract issuing

Once the order/s on www.dere.it is finalised according to the instructions provided on the website throughout the online ordering procedure, DeRe will send an e-mail to the e-mail address provided, confirming the order receipt and laying out the details of the product/s ordered (order receipt confirmation e-mail).

The above mentioned e-mail does not constitute order acceptance, being merely a confirmation of order receipt by DeRe.

The contract between the user and DeRe is deemed concluded only when DeRe sends an e-mail confirming that the product/s has/have been sent (shipping confirmation e-mail).

DeRe will not store an accessible copy of each version of these Terms and Conditions. However, for each purchase he will send an e-mail with the applicable Terms and Conditions along with the order receipt confirmation for the user’s future reference. The user may cancel the order at any time by contacting DeRe (link to contacts page) before receiving the shipment confirmation e-mail.

 

5. Prices, shipment and handling, charges and taxes

The price charged for a product is be the price stated on the information/presentation page of each product at the time of order; it is also shown on the confirmation page prompted upon order finalisation and in the order receipt confirmation e-mail.

Product prices include VAT and other applicable taxes, but do not include shipping costs.

The shipping costs and the related VAT or other taxes will be indicated separately before the order completion, as well as in the order receipt confirmation e-mail. The shipping costs are calculated based on the location and delivery method selected upon checkout.

Products are delivered Monday to Friday.

In August and December, delivery times may be longer.

In any case, order processing times depend on the availability of the ordered products and the payment method chosen.

The goods are packaged directly by DeRe.

The goods are shipped via our partner express courier (GLS).

Shipping restrictions

We ship across Italy with the exceptions of Livigno, Campione d’Italia, post boxes and poste restante.

6. Payment

Payments must be made through one of the methods below by selecting it upon checkout.

Depending on the payment method chosen by the user, the payment will be effected in one phase (through PayPal) or two phases (by credit card).

For credit cards (Visa, MasterCard), a debit authorisation is required upon checkout. The credit and debit cards accepted are listed in the website footer on www.dere.it. If DeRe does not receive the authorisation, DeRe reserves the right to cancel the order. The value of the purchase/s is charged to the card once DeRe has sent the user the shipment confirmation e-mail.

In case of Paypal payment, the value of the purchase/s is charged upon checkout.

 

7. Delivery

Express courier delivery usually requires 3-5 working days for stock items. In any case, delivery will take place within 30 days from the shipment confirmation e-mail.

DeRe reserves the right to replace the courier used for the delivery.

In the event that the user, without reasonable cause, postpones delivery or delays delivery receipt after being notified of attempted delivery by DeRe or in the event that the user has provided a wrong delivery address resulting in failed delivery, the parcel will be returned to DeRe, who will be relieved from the obligation to deliver the items within the agreed delivery time.

Orders are shipped via GLS and a signature is required upon delivery. If nobody is available for signature upon delivery, the parcel will be returned to the GLS warehouse and a note will be left at the recipient address with GLS’ contact information. GLS will make a second delivery attempt on the next business day. In case of failed delivery on the second attempt, the GLS courier will leave a delivery card with GLS’ contact information for the recipient to arrange the delivery according to his/her needs. Please note that the item to be delivered will remain available at the GLS warehouse for 10 working days from the first delivery attempt. DeRe will not be responsible for delayed or failed delivery if the delay or failed delivery is caused by circumstances beyond his control including, but not limited to, war or terrorist acts, strikes, nation-wide or local states of emergency, transport disruptions, power outages, earthquakes, other natural disasters, delivery postponements or delays caused by the recipient.

 

8. Product availability

If a product that the user wishes to order is no longer available, the user will be technically prevented from placing the order. Moreover, in a few exceptional and unforeseeable circumstances, a product indicated as available on the website may appear unavailable after placing the order. In this case, the contract between the user and DeRe shall not be deemed concluded, the user will be notified and the product will not be included in the shipment confirmation e-mail sent to the user. In the event that the payment is made before confirmation of unavailability (e.g. via PayPal), DeRe will refund the amount paid by the user as soon as possible and in any case within 30 days from notification by DeRe of the unavailability of the product.

 

9. Compatibility, product information

The user is required to make sure upon ordering that the products purchased are compatible with their intended use. Please note that, due to graphic reproduction limits, the colour, size and exact design of the items shown on the screen may differ from the actual product characteristics.

If the products received by the user do not match those ordered or if the delivery is incomplete or was damaged during transport, we recommend that the user immediately contact DeRe via e-mail or phone.

 

10. Product ownership

The ownership of the products and the corresponding risks are transferred from DeRe to the user upon product receipt.
